Terms of Use, Privacy Policy, Product License, Refund Policy, and Disclosures

Terms of Use

Effective date: November 1, 2026

1. Agreement to These Terms. These Terms of Use ("Terms") are a legal agreement between you and Hologram Creative LLC, a Washington limited liability company ("Hologram Creative," "we," "us," or "our"). They apply to hologramcreative.co (the "Site"), our social media accounts, our emails, and every free or paid product we offer ("Products"). By using the Site, signing up for a free resource, or buying a Product, you agree to these Terms, our Product License, Refund Policy, and Privacy Policy. If you don't agree, please don't use the Site or our Products.

2. Eligibility. You must be at least 18 years old, or the age of majority where you live, to buy Products. The Site is not directed to children under 13 (under 16 in the EU and UK), and we do not knowingly collect their information.

3. Purchases Through Gumroad. Our paid Products are sold and delivered through Gumroad, which acts as the merchant of record for each sale. Gumroad processes your payment, collects any applicable sales tax or VAT, and its own terms and privacy policy apply to checkout. Prices are listed in U.S. dollars unless stated otherwise and may change at any time, but a price change never affects a purchase you already made. After purchase, you'll receive a download or template link. Please save your files and links promptly. We aren't responsible for access lost because a link was shared, deleted, or expired, though we'll try to help if you contact us.

4. Product Use. Your rights to use any Product, free or paid, are set out in our Product License. Buying or downloading a Product gives you a license to use it. It does not transfer ownership of the Product or any of our intellectual property.

5. Our Intellectual Property. All content on the Site and in our Products, including designs, templates, layouts, workbooks, text, graphics, photos, videos, and branding, is owned by Hologram Creative or used under license from third parties. It is protected by U.S. and international copyright, trademark, and other laws. The name "Hologram Creative," our logo, and related marks are our trademarks. You may not use them without our written permission.

6. Site Content. You may view and share links to our free Site content (such as blog posts and social media posts) for personal, non-commercial purposes. You may not copy, republish, sell, or create derivative works from Site content without our written permission, except as the Product License allows for Products.

7. Prohibited Uses. You agree not to:

Resell, share, distribute, or give away our Products or Site content, in original or modified form
Claim our designs, templates, or written content as your own original work
Use our content or Products to train, fine-tune, or develop artificial intelligence or machine learning models
Scrape, copy, or mirror the Site using automated tools
Interfere with the Site's security or operation
Use the Site or Products for anything unlawful, deceptive, or harmful

8. Educational Content, Not Professional Advice. Our Site, social media, emails, and Products are for educational and informational purposes. They are not legal, trademark, financial, tax, or business advice. Branding decisions, including choosing a business name or logo, may carry legal consequences. Consult a qualified professional before relying on our content for those decisions.

9. No Guarantee of Results. Our Products are tools to help you build your brand. Your results depend on your own effort, business, market, and many factors outside our control. We do not guarantee any specific outcome, including sales, revenue, clients, followers, engagement, or business growth. Any examples or testimonials reflect individual experiences and are not typical or promised results.

10. Third-Party Platforms and Links. Our Products rely on third-party services, including the design platform each Product is built on and Gumroad. Your use of those services is governed by their own terms, which you are responsible for following. We don't control those services and aren't responsible if they change their features, pricing, licensing, or availability, or if they suspend your account. Links to other websites are provided for convenience only and are not an endorsement.

11. Your Submissions and Testimonials. If you tag us, share your work made with our Products, send us feedback, or give us a testimonial, you grant us a non-exclusive, royalty-free, worldwide license to reshare, display, and use that content in our marketing, with credit to you where reasonable. You confirm you have the right to share it. You may ask us to remove your content from future marketing at any time by emailing us.

12. Copyright Complaints. We respect intellectual property rights. If you believe content on our Site infringes your copyright, email hello@hologramcreative.co with the subject line "Copyright Notice" and include: your contact information; a description of the copyrighted work; the location of the material you believe infringes it; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner, with your physical or electronic signature.

13. Disclaimer of Warranties. The Site and Products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We don't warrant that the Site will be uninterrupted or error-free, or that any Product will meet your specific needs.

14. Limitation of Liability. To the fullest extent allowed by law, Hologram Creative and its owner, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of the Site or Products. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim arose or $50.

15. Indemnification. You agree to defend, indemnify, and hold harmless Hologram Creative and its owner, employees, and contractors from any claims, losses, damages, and expenses, including reasonable attorneys' fees, arising from your use or misuse of the Site or Products, your violation of these Terms, or your violation of anyone else's rights, including trademark rights in a name or logo you choose.

16. Termination. We may suspend or end your access to the Site or Products, without refund, if you violate these Terms or the Product License. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive termination.

17. Governing Law and Disputes. These Terms are governed by the laws of the State of Washington, without regard to conflict of law rules. Any dispute will be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. If you are a consumer in the EU, UK, or another country with mandatory consumer protection laws, nothing in these Terms takes away rights you have under those laws.

18. Changes to These Terms. We may update these Terms from time to time. Changes take effect when posted with a new effective date. Changes will not apply retroactively to purchases made before the update. Continued use of the Site after changes are posted means you accept them.

19. General. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the Product License, Refund Policy, and Privacy Policy, are the entire agreement between you and us. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours in connection with a sale or reorganization of our business. We aren't liable for delays caused by events beyond our reasonable control. You agree that notices and agreements we provide electronically satisfy any requirement that they be in writing.

Privacy Policy

Hologram Creative LLC ("we," "us") is the data controller for personal information collected through hologramcreative.co. This policy explains what we collect, why, who we share it with, and the rights you have. We do not sell your personal information.

Purchase details (name, email, product bought)

How we get it: Shared by Gumroad after you buy
Why we use it: To deliver products, provide support, and keep business records
Legal basis (EU/UK): Performing our contract with you; legal obligation
How long we keep it: Up to 7 years for tax and accounting records

Device and usage data (IP address, browser, pages viewed, referring site)

How we get it: Wix analytics and cookies
Why we use it: To understand how the Site is used and improve it
Legal basis (EU/UK): Your consent where required; otherwise our legitimate interest
How long we keep it: As set by Wix, generally up to 2 years

Content you share with us (tags, messages, testimonials)

Why we use it: To respond to you and, with permission, feature your work

We never receive or store your full payment card details. Gumroad handles payment information directly.

2. Who We Share It With. We share information only with service providers that help us run our business, and only as needed:

Wix hosts our Site and provides our analytics, forms, and email marketing (Wix Privacy Policy)
Gumroad sells and delivers our Products as merchant of record and processes payments (Gumroad Privacy Policy)
Wix sends our emails

We may also disclose information if required by law, to protect our rights or the safety of others, or as part of a sale or reorganization of our business.

3. Cookies. Our Site uses cookies through Wix. Essential cookies keep the Site working. Analytics cookies are used only if you accept them in our cookie banner, and declining them won't affect how the Site works for you. You can change your choice through the banner or your browser settings at any time.

4. Emails. You can unsubscribe from our emails at any time using the link at the bottom of every email. We may still send messages about a purchase you made, and some of those (such as receipts and product updates) are delivered through Gumroad on our behalf.

Third-party services you interact with when buying or using our Products, including Gumroad and the design platform a Product is built on, may also contact you directly, for example about your account, your purchase, or their own offers. Those messages are sent under each service's own privacy policy and terms. We don't control them, aren't responsible for them, and can't unsubscribe you from them. To change those preferences, use that service's settings or unsubscribe links.

5. International Transfers. We are based in the United States, and our service providers may store data in the U.S. and other countries. When we transfer personal information from the EU or UK, we rely on our providers' approved safeguards, such as Standard Contractual Clauses or the EU-U.S. Data Privacy Framework.

6. Your Rights. Depending on where you live, you may have the right to:

Access the personal information we hold about you
Correct inaccurate information
Delete your information
Restrict or object to how we use it
Receive a copy in a portable format
Withdraw your consent at any time, without affecting earlier processing
File a complaint with your local data protection authority (in the EU, the authority in your country; in the UK, the Information Commissioner's Office)

To make a request, email hello@hologramcreative.co with the subject line "Privacy Request." We will respond within one month and may need to verify your identity. Requests are free.

7. Children. Our Site is not directed to children under 13 (under 16 in the EU and UK). We do not knowingly collect their information. If you believe a child has given us information, contact us and we will delete it.

8. Security. We use reputable service providers and take reasonable steps to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. Changes. We may update this policy. The effective date above shows when it was last changed. Significant changes will be noted on this page.

Product License

Effective date: November 1, 2026

This Product License explains how you may use the brand kits, templates, and workbooks you get from Hologram Creative LLC, whether paid or free. It is part of our Terms of Use. Each purchase or download grants you a limited, non-exclusive, non-transferable, revocable license, as follows.

At a glance:

DIY Brand Kits and templates: Customize and use commercially for one business. Each additional business needs its own purchase.
Paid workbooks: Use for personal use or for any business you own or operate.
Free resources: Same as paid workbooks.
For all Products: No sharing, reselling, or giving away, and no using them to create work for clients.

1. What You May Do.

Brand Kits and templates: Customize the design with your own name, colors, text, and images, and use the finished result in marketing and materials for one business you own or operate. Each additional business requires its own purchase.
Workbooks: Complete and use workbooks for personal use or for any business you own or operate.
Free resources: Use them on the same terms as paid workbooks.

What "commercial use" means. "Commercial use" means using your customized Product to market, brand, or operate your own business, including in materials you sell or give to your customers (such as your website, social media, ads, business cards, packaging, and client documents). It does not include selling, licensing, or distributing the Product itself, or using it to create work for others.

2. What You May Not Do. Whether a Product is original or modified, you may not:

Resell, sublicense, share, give away, or distribute it, or the template link, to anyone else
Upload it to any marketplace, template library, shared drive, or file-sharing site
Sell or include it, or anything substantially similar, as part of your own templates, kits, digital products, or design services
Use it to create designs for clients or other businesses
Claim the original design or written content as your own creation
Remove our copyright notices from workbooks

3. Third-Party Elements. Our Products include fonts, photos, graphics, and other elements licensed from the third-party design platform each Product is built on (named on each product listing). Those elements are not ours to give you. Your use of them is governed by that platform's own license and terms, which you agree to follow. You may need your own account with that platform to edit a Product. We are not responsible for changes the platform makes to its features, element library, or licensing.

4. Your Designs Are Not Exclusive. Our templates are sold to many customers, and the same base designs and elements are available to others. Even if you purchase a Kit Retirement (below), you will not receive exclusive rights to any design, layout, or element in a Product, and another business may use a similar design.

Kit Retirement. For an additional fee, you may retire a DIY Brand Kit you purchased. Once retired, we will permanently remove that kit from sale and will not sell it again. Please understand what retirement does and does not do:

Earlier buyers keep their rights. Anyone who bought the kit before it was retired keeps their license and may continue using it. We can't tell you who those buyers are or how many there were.
Library elements stay available to everyone. Fonts, photos, graphics, and other elements from the third-party design platform remain available to all of that platform's users and may appear in other designs.
It is not a trademark or ownership right. Retirement does not transfer ownership of the kit to you or give you exclusive rights in its design. Section 5 still applies.
The fee is final. The retirement fee is non-refundable once the kit has been removed from sale.

5. Logos and Trademarks. Because the elements are non-exclusive and licensed from a third party, a logo built from a Product's library graphics, photos, or illustrations generally cannot be registered or protected as a trademark. We make no promise that any name, logo, or design you create with our Products can be registered, protected, or used without conflicting with someone else's rights. You are solely responsible for researching and clearing your business name and logo before using them. If you plan to register a trademark, consult a trademark attorney and use a fully original logo.

6. Your Content. You own the original content you add to a Product, such as your business name, photos you took, and text you wrote. Our license to you does not change that.

7. Ending the License. This license lasts as long as you follow it. If you violate it, the license ends automatically, and you must stop using the Product and any designs made with it. We may also take legal action to protect our rights.

Refund Policy

Effective date: November 1, 2026

All sales are final. Because our Products are digital and delivered instantly, we do not offer refunds, returns, or exchanges once you have received access.

EU and UK customers. By completing your purchase, you expressly request immediate access to the digital Product and acknowledge that you lose your statutory right to cancel within 14 days once access begins. Nothing in this policy limits other rights you have under the consumer laws of your country.

When we will help. Email hello@hologramcreative.co within 14 days of purchase if:

You were charged more than once for the same Product
Your files or template link don't work and we can't fix the problem
You received a different Product than the one you bought

In these cases we will provide a working replacement or, if that isn't possible, a refund through Gumroad. For a duplicate or unauthorized charge, you may also contact Gumroad support directly.

Before you buy. Please read each product description carefully, including which design platform the Product uses and what is included. Reach out with questions before purchasing.

Chargebacks. If you have a problem, contact us first so we can make it right. Filing a chargeback for a Product you received and accessed may result in loss of access to that Product and future purchases.

Disclosures

Effective date: November 1, 2026

Hologram Creative earns money by selling our own digital Products. We do not currently use affiliate links or accept sponsorships.

If that changes, we will only recommend products and partners we genuinely believe in. We will clearly label affiliate links and sponsored content right where they appear, including in social media captions, emails, and on the Site, and we will update this page. Sponsored content will always be visually separate from our own editorial content. We may decline or remove any partnership that is misleading or inconsistent with our values.
